Calls for text driver killer Nikita Ainley to face the family of her victim
THE daughter of a woman killed by texting driver Nikita Ainley wants to meet her face-to-face to explain the devastation she has caused.
Ainley, 20, has been detained for three-and-a-half years for causing the death of Mary Rutherford, 68, while she messaged on her BlackBerry at the wheel.
Now, Mrs Rutherford's daughter Dawn has called for Ainley to face restorative justice once she is released from custody.
Watching Ainley being led from York Crown Court to begin her time behind bars, Dawn said: "I would like to give her some insight into the pain she caused.

"I would be willing to try to get her to recognise what she has done."
Ainley smashed head-on into the Renault Clio carrying Mrs Rutherford in Newfield Lane, Lelley, on May 30 last year.
Despite desperate efforts by paramedics, Mrs Rutherford stopped breathing and died at the scene.
Driver David Newdick suffered a broken arm and breastbone.
His wife, Beryl, a front-seat passenger, had a broken arm and punctured lung.
Ainley claimed at first she had pulled over to send the message on her BlackBerry but had lost control after setting off again.
However, police were able to prove only 48 seconds elapsed between the last message she sent and a witness dialling 999 in the immediate aftermath of the crash.
Ainley changed her plea to guilty on the day a trial was due to begin.
Sending Ainley to a Young Offenders' Institute, Judge Stephen Ashurst, Recorder of York, said: "No message is so urgent that it requires someone to lose their life."

“@Mildred; I truly hope this lady will be forever reminded of her actions. My issue in the main, is that she put the family through hell by denying her guilt and only admitting it at the last minute. However, this is as much of an indictment on our ridiculous and inept justice system as it is on Ms Ainley.”

“Please don't try to suggest that any offence committed under the Road Traffic Act legislation is, by definition, 'not criminal'. Comparing it with speeding offences under the RTA is irrelevant.
She was jailed as a result and has a criminal record, her fingerprints, photo and DNA would have been taken upon arrest. Semantics aside, In all respects she has been found guilty of an offence which attracted a custodial sentence. In anyone's book it's a criminal offence, she committed a crime and she's a criminal languishing in jail.”

“Let's get this right. While we may deem texting at the wheel to be criminal, it is - legally - not.
It is covered under the Road Traffic Act, and the Construction and Use amended bit of the same, as I understand it, and breaking the law with regard to RTA is not "criminal". A few years back, I got 3 points and a £?? fine (it was before it was £60) for speeding. What I did was wrong, in breach of the law, but did not give me a criminal record, or indeed make me a criminal.
And Demonica666 - regardless of how relaxed, or uncaring she may appear (which is despicable and incredible, in spite of that seeming to be the attitude of the majority of young folk these days) she will have the knowledge of what she has done tattooed onto her soul forever.”

“Might I suggest that Ms Ainley has the above photograph of Mrs Timmings (devastated) tattoo'd to the back of her right hand, and a portrait of Mrs Rutherford (deceased due to this lying baggage) tattoo'd on the back of her left hand? That way, every minute of every day, this disgraceful woman will be reminded of the heartbreak her despicable and cowardly actions have caused.”

“Is Dave Navarro a wind up merchant or is he a bit thick?
Texting while driving is not a mistake. It's a criminal act in the same way as any other crime committed is. Is it a "mistake" to murder someone or rob them or burgle their house? No it isn't, it's a crime.
There are many criminal acts that "used to be legal" but so what? They're now illegal.
She should have got far longer in prison, again it's a case of thinking about the poor little scum bag that caused misery to others instead of the victims themselves.”
