Man, 65, breaches asbo for 11th time
A man who repeatedly breaches his anti-social behaviour order by getting drunk has been told to start behaving himself or he could spend the last years of his life in prison.
John Bernard Martindale, 65, has breached his asbo for an eleventh time by drinking in public places.
-

series of breaches: John Bernard Martindale, 65, has breached his asbo for the 11th time by drinking in public.
He breached the order on August 14 and October 6 by drinking in public places.
On August 14 he was seen laid on the pavement near a bus stop on Newland Avenue, west Hull, drinking a container of cider.
On his arrest he told the police officer who found him a bus stop was "not a public place".
He then breached his asbo again at 2pm on October 6 on Prospect Street, Hull city centre, when he was caught drinking a can of lager in a no drinking zone whilst waiting to see his probation officer.
He pleaded guilty at Hull Crown Court to the breaches, but Recorder Henry Prosser decided to defer his sentence until next year.
Recorder Prosser said: "He is a drinker who is a nuisance who does not comply with asbos.
"I'm reluctant to send him to prison.
"If I send you to prison Mr Martindale, you are going to lose the accommodation you have got. I'm prepared to give you a chance.
"I think at your age it is time you started to behave yourself.
"These offences are stacking up.
"I do not want you to spend the last years of your life in prison but it is up to you.
"I'm going to defer sentencing you until January, on condition there are no further breaches."
Martindale has 93 convictions for 127 offences.
Many of his asbo breaches have occurred when he has been drinking in Beverley town centre.
His asbo prohibits him from drinking alcohol and from having an open container of alcohol in any public place in East Yorkshire – except on licensed premises.
He had been given the order in 2004 and it is due to run until 2013.

“"I have heard 'Bernie' lost his family in tragic circumstances but I dont know how true it is. Whatever the reason its affected him mentally and he is using alcohol to blank it out. He really needs help now."
Here we go again, the Beverley rural do-gooders league springs to the defence of a worthless piece of excrement who should indeed be slung in a landfill.
He is an abuser of women who bawls foul language and urinates everywhere, Who cares about his reasons for doing it? Not the people who have to witness him time and again that's for sure.
He's not charming, he's not a character - he's an offensive public nuisance who takes up far to much of the police and criminal justice systems time
What is it about this man that brings out the idiot in otherwise intelligent people?”

“What a waster.
Anyone believing in a god is an idiot. My god-daughter died last week, from cancer. She's a Mum of two lovely boys, and she and her husband had everything to live for, then breast cancer came and took it away. She had no choices.
This fool has a life and he's peeing it up the wall, day after day, and spending taxpayers money in the process.
Life is so unfair. Brian, Hull

Bernie is also in bereavement though he never got the help he required and uses the only tool he can to block out his pain, his radio and his alcohol, he has already been to prison, he already has an asbo, but what he hasnt had is a decent assessment of his needs and treatement, the services are letting him down we all cope with bereavement in different ways. He lost his wife and there is also suspision a significant loss before her.

“He has committed 127 offences in is time, nice man then. I guess if i go out and get drunk everyday i can commit crime and people will feel sorry for me because i am old.”
